Terms of Service
Effective October 18, 2026
These Terms of Service ("Terms") govern your use of HCPCraft (the "Service"), operated by HCPCraft ("HCPCraft", "we", "us"). By creating an account or subscribing, you agree to these Terms on behalf of yourself and the business you represent.
1. The Service
HCPCraft is business-to-business (B2B) software for marketing and email production teams. It generates HTML emails from the mockups, copy documents and other files you provide, applies email-client compatibility fixes, runs automated checks, and produces audit screenshots and reports to support your review process, for example in Veeva PromoMats.
The Service is a production tool. It does not provide medical, legal or regulatory advice, and it does not approve content. You remain responsible for reviewing every email it produces and for obtaining any required medical, legal and regulatory (MLR) approval before use. Automated checks can miss issues, and we do not guarantee that any email will be approved by your reviewers or accepted by any platform.
The Service is offered to businesses and professionals only, not to consumers. You must be at least 18 years old and authorized to bind your organization.
2. Accounts and team seats
- You sign in with a Google account. Keep it secure; activity under your account is your responsibility.
- On plans with team seats, the account that pays for the plan (the “owner”) may invite teammates by email. Teammates use the owner's plan and share its monthly email quota and its email history. The owner is responsible for the teammates it invites and may remove them at any time.
- You must give accurate information and keep it up to date.
3. Plans and usage limits
The paid plans are billed monthly in US dollars:
- Pro Solo: $99/month, 50 emails per month, 1 user.
- Agency: $199/month, 120 emails per month, up to 3 users.
- Unlimited: $499/month, unlimited emails under our fair-use policy, up to 5 users.
Each email generation, including each “Resend with Adjustments” revision, counts as one email against the plan's monthly quota. The quota renews at the start of each billing period; unused emails do not carry over. A generation that fails and delivers no email is not counted.
Fair use (Unlimited plan): “Unlimited” is intended for normal production use by up to 5 team members. To protect the Service for all customers, accounts above 1,000 emails in a billing period may be paused until the next period, or we may contact you to agree on suitable terms.
A free preview lets anyone browse example emails; it does not include generating emails from your own files.
4. Payment, renewal and taxes
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Your purchase is also subject to Paddle's Buyer Terms.
- Subscriptions renew automatically every month on the same day as your first payment, and are charged to your payment method until you cancel.
- Prices exclude applicable taxes, which Paddle calculates and collects at checkout.
- When you change plans, the change takes effect immediately and Paddle prorates the difference for the rest of the billing period.
- We may change prices with at least 30 days' notice; the new price applies from your next renewal after notice.
- If a payment fails, Paddle retries it; access may be suspended if payment cannot be collected.
5. Cancellation and account deletion
You can cancel at any time from your account page. Cancellation takes effect at the end of the current billing period: you and your team keep your plan, quota and email history until then, and you are not charged again. Deleting your account also takes effect at the end of the paid period; after that, access ends, and your email history is retained for 90 days for compliance and audit purposes before it is permanently deleted. Refunds are described in our Refund Policy.
6. Acceptable use
You agree not to:
- upload protected health information (PHI) or other personal data about patients. The Service is designed for promotional and educational marketing content, not patient records;
- upload content you do not have the right to use, including brand assets you are not authorized to use;
- use the Service for unlawful, misleading or harmful content, or to send unsolicited email (spam);
- attempt to break, overload, reverse engineer or resell the Service, or bypass usage limits or seat limits;
- share one seat between several people.
7. Your content
You keep all rights to the files, copy and assets you upload and to the emails generated for you. You give us a limited license to process that content solely to provide the Service to you, as described in our Privacy Policy. We do not claim ownership of your content and do not use it to market to others.
Emails are generated with the help of artificial intelligence. Output may contain errors or omissions, and similar input may produce different output. Always review the result against your approved source materials.
8. Our property
The Service, its software, design and documentation belong to HCPCraft. These Terms do not transfer any of our intellectual property to you. Veeva and PromoMats are trademarks of Veeva Systems Inc.; HCPCraft is an independent product and is not affiliated with or endorsed by Veeva.
9. Availability and changes
We work to keep the Service available and secure but do not guarantee uninterrupted operation. We may improve or change features over time; if a change materially reduces a paid feature you rely on, you may cancel.
10. Disclaimers and limitation of liability
The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all implied warranties, including fitness for a particular purpose and non-infringement. We are not liable for indirect, incidental, special or consequential damages, lost profits or lost data, or for regulatory outcomes of content you publish. Our total liability for any claim relating to the Service is limited to the amount you paid for the Service in the 12 months before the claim.
11. Suspension and termination
We may suspend or terminate access if you materially breach these Terms, misuse the Service, or fail to pay. You may stop using the Service at any time.
12. Governing law
These Terms are governed by the laws of Costa Rica, without regard to conflict-of-law rules. Disputes will be resolved by the competent courts of Costa Rica, unless applicable law requires otherwise.
13. Changes to these Terms
We may update these Terms. We will post the new version here with its effective date and, for material changes, notify account owners by email at least 30 days before they apply. Continuing to use the Service after that means you accept the updated Terms.
